1. Agreement to These Terms

By opening a Lumina account, signing in, or otherwise interacting with any feature of the platform (together, the "Service"), you confirm that you have read these Terms of Service and accept them in full. Acceptance becomes effective the moment you tick the box, tap the equivalent button, or simply continue using the Service after registration.

From your very first session onwards, the document below is treated as having been understood and approved by you without reservation. If any provision is unacceptable to you, please discontinue use of the Service immediately.

DIGIDROP SP z.o.o (the "Company") may revise these Terms whenever it is necessary to reflect new product features, legal developments, or operational changes. Material updates will be communicated to you in advance through your registered email address or through an in-app notice. Continuing to use Lumina once an update is in force constitutes acceptance of the revised version.

2. What Lumina Offers

Lumina is an online environment dedicated to adult users who wish to socialise, exchange messages, and explore romantic possibilities for strictly personal purposes. The Company acts solely as a technology provider operating the platform; it does not provide matchmaking, marriage brokerage, or any kind of personalised counselling.

Each member's expectations are individual, and the Company therefore offers no guarantee that any specific outcome will be achieved — including, without limitation, finding a long-term partner, organising in-person meetings, or moving in together. The Service can equally be enjoyed as a conversational and entertainment platform.

Through Lumina, registered users may, among other things:

  • Build a personal profile complete with photos, biographical details, and preferences
  • Browse, like, and connect with other members
  • Send and receive private messages
  • Receive compatibility-based suggestions
  • Filter potential matches by criteria they choose
  • Acquire and exchange virtual gifts
  • Manage a personal Credits balance
  • Convert eligible received gifts into real funds via our payout programme
Safety reminder. Should you decide to meet another member offline, the Company strongly advises informing a trusted person beforehand, choosing a public location, and never being alone with a stranger. Bear in mind that the internet allows individuals to misrepresent their identity, so remain cautious at all times.

3. Registration and User Accounts

3.1 Opening an Account

To enjoy Lumina you must create an account by submitting accurate, current, and complete information. You are responsible for keeping your sign-in credentials confidential and must not share them with anyone.

3.2 Minimum Age

Access to the Service is restricted to individuals who have reached the age of majority in their country of residence and, in any event, are at least 18 years old. By registering, you affirm that you meet this requirement.

3.3 Account Protection

Anything that happens on or through your account is your responsibility. If you suspect that someone else has obtained your password or otherwise accessed your account, contact us without delay so that protective measures can be applied.

4. Conduct, Authenticity, and Member Obligations

4.1 Personal, Non-Commercial Use

The Service is reserved for individual, non-commercial use. The account is strictly personal (intuitu personae): it cannot be lent, transferred, sold, jointly operated, or made available to a minor under any circumstances. You alone bear responsibility for the way in which your account is used and for all consequences flowing from it, particularly any improper, abusive, fraudulent, or unlawful behaviour. You agree to use Lumina honestly and in line with these Terms and the laws and regulations applicable to you, including those protecting privacy.

4.2 Truthful Profile and Photos

So that interactions on the platform remain trustworthy, every member commits to providing genuine information — particularly regarding age, gender, and orientation. Impersonation of another person, by reusing their name, nickname, or images, is forbidden.

Photographs uploaded to the Service must depict only the member as a real person; pictures of pets, third parties, or minors are not permitted. The publication of any content involving minors in a sexual context, or content promoting prostitution or any paid sexual service, is strictly prohibited and will be reported to the competent authorities where required.

4.3 Prohibited Behaviour

You agree not to use the Service to:

  • Publish, share, or transmit material that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Impersonate any individual or entity, or misrepresent your relationship with one
  • Upload content that infringes a patent, trademark, trade secret, copyright, or any other proprietary right
  • Distribute unsolicited advertising, promotional content, chain letters, spam, or any other form of solicitation
  • Disrupt the Service or the networks and servers that support it
  • Attempt to gain unauthorised access to any portion of the Service or related systems
  • Disclose to other members your postal address, personal email, real-life identity, or telephone number, or request such details from them
  • Ask other members for money or accept money from them, regardless of the justification
  • Introduce viruses, trojans, worms, or any other technology capable of harming the Service or its users

4.4 Tone of Communication

Members are expected to communicate respectfully, politely, and considerately. If a proposal does not match your expectations, decline courteously rather than respond aggressively. Suspicious behaviour or content can be flagged at any time using the in-app "Report" option.

Privacy of fellow members must always be respected. Do not share, through Lumina or elsewhere, the names, surnames, postal addresses, or email addresses of other members, and treat any information confided to you with strict confidentiality.

5. Virtual Currency, Gifts, and Earnings Programme

5.1 The Credits System

Lumina operates an in-platform virtual currency referred to as "Credits". Credits exist exclusively inside the Lumina ecosystem, cannot be spent on any other website or service, and have no intrinsic monetary value outside the platform.

5.2 Buying Credits

Credits can be acquired with real money through the secure payment options offered on the platform, including major credit and debit cards and other approved processors. All Credits purchases are final and non-refundable except where applicable consumer-protection law states otherwise. The Company sets, and may adjust at its discretion, the exchange ratio between local currency and Credits without prior notice.

5.3 Virtual Gifts

Members can use Credits to acquire virtual gifts and send them to other members as a sign of attention, sympathy, or affection. These gifts are decorative items that exist only inside Lumina; they have no real-world value. The selection and pricing of virtual gifts may evolve at the Company's discretion.

5.4 Gift Earnings Programme

Recipients of virtual gifts may, subject to eligibility checks, take part in our earnings programme, which converts received gifts into real funds. The main rules of this programme are:

  • Conversion ratio: received gifts may be cashed out at a fixed proportion of their original Credits value, as published in the platform
  • Minimum payout: a minimum balance must be reached before a withdrawal request can be submitted
  • Processing time: approved withdrawals are normally settled within 5 to 10 business days
  • Payout channels: funds are released only to verified bank cards or other approved methods registered to the member

5.5 Identity Verification

Participation in the earnings programme is conditional on each of the following:

  • Being at least 18 years old and presenting a valid government-issued ID
  • Successfully completing our identity verification procedure
  • Demonstrating ownership of the bank card or payout method used
  • Complying with the tax obligations applicable in your country of residence

5.6 Financial Compliance

Important. Lumina is not a bank, payment institution, or money-service business. We do not offer financial advice, investment services, or banking products. Our earnings programme is a platform feature comparable to creator-monetisation programmes operated on other social platforms.

The Company reserves the right to:

  • Request additional documents to confirm identity or ownership of payout means
  • Suspend or terminate access to the earnings programme for users who breach these Terms
  • Update the rules of the earnings programme by giving 30 days' prior notice
  • Apply anti-money-laundering (AML) and know-your-customer (KYC) procedures as required by law
  • Report transactions to the relevant authorities where regulation requires it

5.7 Tax Liability

Members who join the earnings programme are themselves responsible for:

  • Declaring revenues from gift conversions to the relevant tax authority
  • Paying any tax due on those amounts
  • Keeping appropriate records of their transactions
  • Seeking professional tax advice when necessary

5.8 Earnings-Related Misconduct

The following activities are forbidden and will lead to suspension or termination of the account:

  • Creating fake or coordinated accounts to send gifts to oneself or to affiliated accounts
  • Manipulating the gift system through any deceitful method
  • Purchasing Credits with stolen or unauthorised payment instruments
  • Trying to bypass identity verification
  • Money laundering or any other illegal financial activity
  • Coordinating with other members to inflate gift exchanges artificially

5.9 Fees and Charges

Fees may apply, in particular for: Credits purchases (already included in the displayed price), withdrawal processing (deducted from the payout amount), currency conversion when relevant, and additional verification services should they be required.

5.10 Disputes Linked to the Programme

For any dispute arising from the earnings programme, members must first contact our support team through the official channels. Claims must be raised within 30 days of the relevant transaction. The Company will examine each case in good faith but retains final decision-making authority. Decisions concerning gift monetisation are final and binding.

6. Availability and Performance of the Service

The Company strives to keep Lumina accessible 24 hours a day, 7 days a week, and to maintain a high level of quality. However, scheduled maintenance, technical incidents, or constraints beyond our control may temporarily limit access.

Given the nature of the internet — its bandwidth limits, latency, and inherent unreliability — the Company cannot guarantee uninterrupted accessibility, error-free operation, or specific response times.

The Company reserves the right, without prior notice and without compensation, to temporarily or permanently suspend access to the Service to perform updates and maintenance, or whenever a security risk or threat to the integrity of member data requires it.

7. Moderation and Editorial Profiles

The Company encourages members to explore Lumina's features and continually adjusts the platform to deliver the best possible experience. To support engagement and to detect or prevent malicious behaviour, members agree that the Company may operate moderation activities through messaging or email, and may interact with members through dedicated profiles or images.

Members acknowledge that some profiles, photos, or conversations on the Service may have been created or animated by the Company for moderation, animation, or entertainment purposes, and that they do not necessarily correspond to a single real person. Lumina is intended both as a place to make connections and as a source of conversation and entertainment.

8. Right of Withdrawal

In line with applicable consumer-protection rules, paid subscribers benefit from a fourteen (14) day right of withdrawal, counted from the date the paid service is activated, with no penalty and no need to give a reason.

To exercise this right, the subscriber must notify the Company of their decision through an unambiguous statement, sent via the contact form or by post to the address listed in the Operator Details above.

Effect of withdrawal: the Company will refund all amounts paid for the subscription without undue delay and, in any event, no later than fourteen (14) days following receipt of the withdrawal request, using the same payment method as the original transaction unless agreed otherwise.

9. Privacy and Personal Data

Your privacy matters to us. The handling of personal data on Lumina is described in detail in our Privacy Policy, which forms an integral part of these Terms. Where the Privacy Policy contemplates sharing data with commercial partners, you can opt out at any time from your account settings under the alerts and newsletters section.

10. Content and Intellectual Property

10.1 Content You Submit

You retain ownership of the photos, texts, and other materials you upload to Lumina. By submitting content, you grant the Company a worldwide, non-exclusive, royalty-free licence to host, display, reproduce, adapt, and distribute that content as required to operate, promote, and improve the Service.

10.2 Lumina's Intellectual Property

The Service and its original elements — including its features, layout, and underlying code — are owned by the Company or licensed to it, and are protected by international copyright, trademark, patent, trade-secret, and other intellectual-property laws.

The platform, brand names, designs, models, images, texts, photographs, logos, graphic identity, software, search engines, databases, and domain names — without that list being exhaustive — are the exclusive property of the Company or its licensors.

Any reproduction, representation, modification, or extraction, in whole or in part, of any of these elements without the Company's express written consent is forbidden and may constitute counterfeiting punishable under the applicable laws.

11. Payment Conditions and Financial Compliance

11.1 Buying Credits

Credits are sold through our integrated payment gateway using the secure means displayed at checkout. All purchases are final and non-refundable, except where applicable law expressly states otherwise. Prices may change without prior notice.

11.2 Processing and Security

All financial transactions are processed by certified payment service providers that meet recognised industry security standards, including PCI DSS. Lumina does not store full card details on its own servers.

11.3 Regulatory Framework

The earnings programme is operated in compliance with, among others:

  • The European Union Payment Services Directive (PSD2)
  • Applicable Anti-Money Laundering (AML) regulations
  • Know-Your-Customer (KYC) requirements
  • Polish financial-services regulations
  • International sanctions and compliance obligations

11.4 Transaction Monitoring

All transactions are subject to ongoing monitoring for unusual or suspicious activity. Where appropriate, the Company may freeze accounts, request supplementary documentation, or notify the competent authorities, as required by law.

12. Account Closure and Termination

12.1 Closure by the Member

You may close your free account at any time by selecting "Delete account" (or equivalent option) from the "My Account" section. The closure of a free account becomes effective immediately upon confirmation. Active paid subscriptions are governed by their own renewal and cancellation rules.

12.2 Closure by the Company

The Company may suspend or terminate your account, and restrict your access to the Service, immediately and without prior notice or liability, where it considers, in its sole discretion, that you have breached these Terms. In addition, where an account has remained inactive for five (5) consecutive years, the Company may close it after notifying the member by email.

12.3 Effects of Closure

Once closure becomes effective, the personal account is permanently deleted within 48 hours, subject to legal retention obligations. After this point, the data and information collected through your use of the Service can no longer be recovered by the member.

13. Force Majeure

An event of force majeure suspends the performance of the Service for as long as the impediment lasts. If the obstacle proves permanent, these Terms are terminated by operation of law and both the member and the Company are released from their obligations under the conditions provided by applicable civil law.

Are expressly considered events of force majeure: war, riots, fire, internal or external strikes, lock-outs, occupation of the Company's premises, severe weather, earthquakes, floods, water damage, restrictions on commercial activity, accidents of any nature, epidemics or pandemics, illnesses affecting more than 10% of Company personnel over two consecutive months, interruptions of energy supply, partial or total outage of the internet network or other public/private electronic communications networks, road blockages, supply shortages, power cuts, and any other event beyond the reasonable control of the parties that prevents the normal performance of these Terms.

14. Disclaimers and Limitation of Liability

14.1 "As Is" Service

Information provided through the Service is supplied on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, the Company excludes all representations, warranties, conditions, and terms relating to the Service. The Company cannot be held liable if a member fails to find a partner or if registration does not lead to the relationships they had hoped for.

14.2 Limitation of Liability

To the fullest extent permitted by law, neither Lumina nor its directors, employees, partners, agents, suppliers, or affiliates shall be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, use, goodwill, or other intangible losses — arising from your access to or use of the Service.

The Company cannot be held responsible in cases of temporary or total unavailability of all or part of the Service, slow response times, or any other performance issue. The Company is also not liable for fraudulent or abusive use of an account resulting from voluntary or accidental disclosure of credentials by the member.

15. Severability

Should any provision of these Terms be held invalid or unenforceable by application of a law, regulation, or final decision of a competent court, the remaining provisions will continue in full force and effect.

16. Evidence

Data collected and stored by the Company under reasonable security conditions are deemed evidence of the communications exchanged between the member and the Company. Acceptance of these Terms by electronic means and any subscription to paid services or other contractual commitment made online by the member have, between the member and the Company, the same probative value as a paper document signed by hand.

17. Governing Law and Jurisdiction

These Terms are interpreted and governed by Polish law, without regard to its conflict-of-law provisions. Any dispute arising from these Terms or the use of the Service falls within the exclusive jurisdiction of the competent courts of Warsaw, Poland, subject to the mandatory consumer-protection rules of the user's place of residence.

18. Updates to the Terms

The Company may modify or replace these Terms at any time at its sole discretion. Where a revision is material, we will provide at least thirty (30) days' notice before the new version takes effect, by means we consider reasonable, including in-app notifications or email.
